The suit claims the airline, which shut down last month at its location at Smith Reynolds Airport, didn't provide sufficient notice before laying off employees.

The suit asks that the named employees be paid 60 days of pay and benefits which they say they are due under federal law.

Pace Airlines CEO William Rodgers is scheduled to make a court appearance Friday morning in Forsyth County.

Rodgers was arrested at Piedmont Triad International Airport last month on charges he failed to pay the company's group health insurance policy premiums.
