LEVERAGING PART 16 VIOLATIONS: A legal perspective

Long-time aviation attorney Paul Lange heads up an in-depth and analytical look to assist airport tenants in 1) identifying potential Federal Grant Assurances issues stemming from the unfair treatment of the tenant by the airport sponsor; 2) using Freedom of Information laws to obtain evidence in support of a proposed Part 16 action; 3) using a proposed Part 16 Complaint to get the attention of the airport sponsor with respect to issues of unfair treatment of the airport tenant; and 4) using the threat of a Part 16 Complaint to effectively negotiate the resolution of the issues identified therein.

Paul Lange: The Law Offices of Paul A. Lange, LLC, works with clients nationwide who are either pursuing or defending against the threat of a Part 16 Complaint and any related litigation. Mr. Lange began handling airport matters as an FAA attorney, and brought that perspective to the private sector after leaving federal service. David Cushing currently serves as the FAA's Manager of the Los Angeles Airports District Office, since December 2011. From 1996 through 2011, Dave worked in the Airport Compliance Division in Federal Aviation Administration's Office of Airports in the Washington Headquarters. In that capacity, Dave drafted about 50 Part 16 decision documents, including Director's Determinations, Final Agency Decisions, Notices of Investigation, Briefs and Orders. He developed policy in compliance, including Part 16 complaint process requirements, airport land release, disposition of airport property, requirements of airport land-use and allowances for airport marketing and promotion. He provided guidance to FAA regional offices, airport sponsors, Congress, the press, interest groups and the public on all issues of airport sponsor compliance with grant assurances and Federal law. Prior to joining the FAA in Compliance, Dave worked for the Division of Aviation for the State of Kansas doing system's planning; airport safety data and airspace analysis; small airport consultation; and governmental relations.
