Texas Bill Criminalizes Excessive Airport Pat-Downs

The Texas Travel Freedom Act (HB 80) would make it a criminal act to intentionally touch "the anus, breast, buttocks, or sexual organ of the other person, including touching through clothing," without probable cause.

The Tenth Amendment Center's Mike Maharrey supports the bill, saying that citizens ought to be able to retain their dignity-even in an airport:

"If you walk up to somebody and grab their crotch out on the street, it will land you in jail. Blue uniforms and federal badges don't grant some goon the power to sexually assault you, or at least they shouldn't. A person doesn't forfeit her or his personal dignity with the purchase of an airline ticket."

A 2011 version of the bill passed the house, but stalled after federal officials claimed that threatening TSA employees with criminal punishments would make it difficult to keep airports open.
