Arguments continue stacking up in JetAway Aviation’s appeal of the antitrust case it brought against Montrose County and other defendants.

The antitrust suit, which had argued conspiracy and restraint of trade, was dismissed by U.S. District Judge Richard Matsch in March.

JetAway appealed a short while later. Since filing the appeal, it has come to the county with an offer to dismiss — if the county allows it to build an on-airport fixed-base operator, which would be managed by Phoenix-based Cutter Aviation.

The county says it has no doubts about Cutter, but plenty of reservations about JetAway, which it contends has violated minimum standards applicable to Montrose Regional Airport, as well as airport safety regulations.
