SBD Airport Services Asks Judge To Restore Access To Fuel
SAN BERNARDINO - Attorneys for the bankrupt SBD Airport Services are asking a federal judge to force San Bernardino International Airport administrators to restore the company's access to the airport's fueling facilities.
"Defendants' wrongful conduct, including but not limited to the purported termination of the Fuel Agreement ... will cause great and irreparable injury," the complaint reads.
The complaint also alleges that SBD Aircraft Services suffered at least $20 million in damages after airport managers blocked the company from SBIA's fueling facilities in February.
The attorneys filed their new complaint on Tuesday in U.S. Bankruptcy Court in Riverside. SBD Airport Services sought bankruptcy protection in early March and the company has claimed SBIA's leaders have tried to cripple their business operations.
SBD Aircraft Services is one of multiple companies at SBIA that are managed by Scot Spencer. SBD Aircraft services declared bankruptcy in March after the airport's interim chief, A.J. Wilson, blocked the Spencer-managed SBD Properties from accessing the airport's "fuel farm."
SBD Properties managed the upscale Million Air franchise at SBIA, which before the dispute was the airport's crown jewel.
SBIA lacks a contract with a passenger carrier, but the Million Air deal provided the airport a means to provide services to private flyers.
Million Air severed its relationship with Spencer after he lost access to the airport's fuel supplies.
Wilson has asserted that Spencer breached his fuel agreement with the airport when the pilot of a 727 jet was unable to receive the full amount of requested fuel.
Spencer's spokesman, Coby King, could not be reached immediately for comment Thursday but has accused Wilson of bullying Spencer during recent months.
Wilson took charge at the airport after the FBI raided SBIA offices and other locations, including Spencer's home in October 2011 while investigating alleged corruption at SBIA.
A hearing on the fuel dispute is scheduled for May 14.
